By using MintedBrain ("we," "us," or "our"), you agree to these Terms of Service. See also our Privacy Policy.

1. Nature of the Service

MintedBrain curates and displays information about AI tools, tasks, courses, tutorials, and related content. Our service is informational only. We do not operate, endorse, or guarantee any third-party tools or services listed on our site.

For signed-in users, we offer a personalized "For You" feed that surfaces tasks, tools, courses, learning paths, tutorials, and blog posts based on your selected interest categories and learning progress. You can update your interests in your account at any time. Recommendations are algorithmic and do not constitute endorsements.

2. Eligibility and Age Requirement

You must be at least 13 years old to use our service. If you are under 18, you should have your parent or guardian review these Terms and supervise your use. By creating an account or using our service, you represent that you meet these requirements.

3. Account Creation and Responsibility

When you create an account, you agree to:

Provide accurate, current, and complete information
Provide a display name (required; used on certificates and in your profile)
Maintain and promptly update your account information (including interest categories used for personalized recommendations)
Keep your password and account credentials confidential
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized access or security breach

We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Acceptable Use

You agree not to use our service to:

Violate any applicable law or regulation
Infringe the intellectual property, privacy, or other rights of others
Transmit spam, malware, or harmful code
Impersonate any person or entity or misrepresent your affiliation
Harass, abuse, or harm others
Attempt to gain unauthorized access to our systems, accounts, or data
Interfere with or disrupt our service or infrastructure

We may suspend or terminate your account and access to our service if we reasonably believe you have violated these terms or engaged in conduct harmful to us or others.

5. User Content and Submissions

If you submit content through our service (e.g., tool submissions, feedback, or other materials), you retain ownership of that content. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, modify, adapt, display, and distribute your content as necessary to operate and improve our service.

Reviews, comments, and feedback. When you submit content about MintedBrain, our site, our courses, or our products—including public reviews, discussion comments, ratings, or site/product feedback—you grant us the right to use that content, together with the display name on your account (and any other attribution shown in the product), for marketing and promotional purposes. Those uses may include, without limitation, testimonials, social media posts, email campaigns, paid advertising, and display on our homepage or elsewhere on the site or in our apps. You may not receive compensation for such use. We may edit or shorten excerpts for clarity or length.

Internal notes. Optional fields you submit that are labeled only for our internal team may be used to operate and improve the service; we will not use them as public testimonials unless we obtain your separate consent.

Contact about reviews. We may contact you at the email address associated with your account if we need more context about your review. Submitting a review requires the consent you give in the product (including the checkbox on the review form).

You represent and warrant that you have all rights necessary to submit your content and that your content does not violate these Terms or any applicable law. We are not obligated to publish or retain any content you submit and may remove it at our discretion.

6. Newsletter and Email Communications

By subscribing to our waitlist or newsletter, you agree to receive emails from us, including welcome messages, launch announcements, product updates, and digests (if you opt in). We will continue to send you emails for as long as you remain subscribed. You may unsubscribe at any time via the link in any email or at mintedbrain.com/newsletter/unsubscribe. Your subscription and receipt of emails are governed by these Terms and our Privacy Policy.

7. No Professional Advice

Nothing on this site constitutes professional, financial, legal, or technical advice. Content is for informational purposes only. You are responsible for your own decisions and use of any tools or services.

8. Third-Party Links

We may link to third-party websites or tools. We are not responsible for their content, terms, or practices. Your use of third-party services is at your own risk.

9. Disclaimers

OUR SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE (AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless MintedBrain and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of our service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit.

12. Account Termination

You may delete your account at any time through your account settings or by contacting us. We may suspend or terminate your account and access to our service at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

Upon termination, your right to use our service ceases immediately. We may retain certain information as required by law or for legitimate business purposes, as described in our Privacy Policy.

13. Amendments and Changes to Terms

We reserve the right to amend or modify these Terms at any time. We will post the updated Terms on this page with a new effective date. When we make material changes, we will notify you by email. The email will contain a direct link to the updated Terms of Service so you can review them. Continued use of our service after changes constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using our service and may delete your account.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or our service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
